Trump's Regime of Consequences and Incentives

Trump's voracious desire for retribution has rapidly morphed into a methodical apparatus. During the year since his election, the president's anger and caprices have assumed the guise of government actions in ways comparable to historical repressive regimes. Government figures who fail to comply are immediately removed and substituted by loyalists. Political leaders who confront him risk indictment, court proceedings and punishment. Adversaries have been designated under executive orders as “unpatriotic”, “anti-Christian” and “opposing economic freedom”, and warned with prosecution as “extremists”.

Federal Agencies Transformed

All case involving legal action of critics and leniency for loyalists demonstrates its own particular qualities. However, regardless of their particular character, they represent expressions of what has emerged as a systematic method. Those incidents are far from coincidental. The administration's removal of federal attorneys and law enforcement agents, coupled with his installation of loyalists in senior positions, started rapidly, soon assumed a consistency, and has now been formed into a system. The justice department and the law enforcement agency have been remade into ideological bodies under his direct command to carry out his demands. Injustice has been turned into routine. It constitutes the retribution system.

Administration is more concerned with penalizing the leader's alleged adversaries than they are with protecting our public welfare.

Within the Structure

The beginnings of this system has been exposed in the court filing of multiple ex- senior FBI agents submitted in late summer in the judicial system in the capital against FBI director Kash Patel and attorney general a key figure for unlawful firing in “a campaign of revenge against them for what Defendants considered to be a refusal to demonstrate adequate allegiance”. According to the filing that Brian Driscoll, the ex- temporary head, details a conversation in which the director “freely acknowledged the impropriety of his actions”.

Driscoll had attempted to defend agency personnel from being dismissed, the complaint alleges. He informed him that “they” – interpreted by the official to be the White House and justice department – had directed him to remove all those who they identified as having participated in a criminal investigation against Trump. The filing goes on: “He stated that he had to terminate the personnel his leaders told him to fire, because his capacity to hold his own position was contingent on the removal of the officials who worked on cases involving the chief executive. The director commented that there was no option he or the official could do to halt these or any other firings, because ‘the FBI sought to put the President in detention and he recalls it clearly.’” When he told the director he was violating the FBI's own policies, the director supposedly said “he understood that and he realized the nature of the immediate dismissals were almost certainly illegal”.

Broad Effects

Since his alleged acknowledgment to him, the justice department and the Federal Bureau have been dismantled and repurposed for the administration's retribution system. Several of the agency's high-ranking agents were dismissed or compelled to leave in the first days of the presidency. Approximately 4,500 lawyers at DoJ have taken a “early exit scheme”. A minimum of several DoJ lawyers, including those in the Manhattan division, stepped down in protest over what they considered as ideological pressure in abandoning the legal action against the local official, Eric Adams, in as a trade for his assistance with the administration's Immigration and Customs Enforcement arrests of immigrants. The ethics division of the department, which handles ethical violations, has been cut down to minimal staff. The equality section has been decimated: 70% of its employees has left. A third of executives at the justice department have left. The unit implementing conservation statutes has seen departures of 50% its leadership.

Rewards and Penalties

In the mayor's situation, the acting US attorney for the southern district of New York, she, quit in dissent against what she described as the “exchange”. The border official, Trump's “enforcement chief,” showed up as the enforcer with Adams on television to announce: “Should he fail to deliver, I will return in New York City.”. Additionally, Emil Bove, formerly the acting deputy attorney general and a former Trump attorney, who brokered the deal, was awarded an court role, a possible pathway to the judicial branch.

Trump's immunity for crimes perpetrated while in power, provided by the extraordinary decision of the GOP-led on the highest court, thus preventing his prosecution over the political violence and maintaining his public standing for the 2024 election, is the cornerstone on which he stands to protect his loyalists. Under these circumstances, he has been liberated to permit misconduct. The effect of the court judgment saturates his presidency and the political party completely. The legal case has spread. In the words of a past leader's administration lawyer John Dean remarked about the Watergate
